In a 6-3 decision, the U.S. Supreme Court struck down Donald Trump’s executive order attempting to end birthright citizenship on June 30, rejecting the administration’s claim that the president has the authority to deny citizenship to U.S.-born children based on their parents’ immigration status. The Court upheld the plain text of the 14th Amendment: anyone born on American soil is a citizen of the United States.
In Colorado, roughly 80,000 U.S. citizen children are growing up with an undocumented parent. Under the now-defeated executive order, their citizenship would have been called into question solely because of who their parents are. These children were born here; in our hospitals, in our communities. They are our neighbors, our classmates, and our future. The June 30th ruling ensures their place in this country is beyond question.
“This ruling affirms what we have always known. The Constitution protects every child born in this country, regardless of who their parents are or where they come from,” said David Navas, Political Manager at the Colorado Immigrant Rights Coalition. “No president, past or present, has the power to override that fundamental truth with an executive order.”
In April, Trump became the first sitting president to attend Supreme Court oral arguments, sitting in the public gallery as his legal team defended the order. That unprecedented move did not change the outcome. The Court’s ruling delivers a definitive rebuke to an administration that overreached in its attempt to redefine who belongs in America.
“This fight was to protect every child born here from having their rights questioned by a future administration. Today, we shut the door on that executive overreach,” Navas added. “Our work continues, and we will keep defending Colorado’s immigrant families every step of the way.”
