On June 30, Families Not Politics released a statement following the Supreme Court’s decision in West Virginia v. B.P.J., upholding West Virginia and Idaho’s state laws banning transgender students from participating in school sports teams.
“Today’s SCOTUS decision allows existing state bans on transgender student athletes to stand, but it does not require states to adopt them. Colorado can continue to allow all kids to participate in school sports and leave decisions about school athletic policies to the people who know students best: educators, coaches, athletic associations, families, and other experts — not politicians. Students deserve the chance to grow, learn, and belong. Blanket bans that treat kindergarteners the same as high school athletes, a recreational league the same as a competitive league, and every sport exactly the same do not advance fairness; they breed exclusion.
Supporters of Initiative 109 may claim that the Supreme Court ‘settled’ this issue, but that is not true. This decision is not the final word and it does not require Colorado to abandon its values. Colorado voters will still decide what kind of state we want to be – one that protects children and chooses dignity, privacy, fairness, and belonging – and we expect them to do so this November by voting no on Initiative 109.”
Initiative 109 would require school boards and other government entities to develop policies for determining whether students are male or female. This could force all students to confirm their gender simply to participate on a team, opening the door to invasive inspections and humiliating scrutiny that risk the safety and well-being of all Colorado children. In practice, it could allow anyone to demand inspections of young girls who look “too tall” or “too strong” just to let them play sports.
