Colorado Supreme Court Decision: Boe V. Children’s Hospital Colorado

On May 18, the Colorado Supreme Court ruled 5-2 in Boe v. Children’s Hospital Colorado, ordering the trial court to issue a preliminary injunction directing Children’s Hospital Colorado to once again provide health care for transgender youth.

While we await a final decision on the merits, today’s ruling is a victory for the incredibly brave families who have been advocating tirelessly for their children. All families deserve the freedom to work with doctors to ensure that their child can receive the care they need. With this ruling, the Colorado Supreme Court has recognized the resilience of Colorado families who refused to back down when their children’s well-being was on the line.

One Colorado is deeply grateful for this development, which brings profound relief to transgender youth and those who love them. For years, so many of Colorado’s dedicated providers have stood in our corner, navigating an increasingly complex political landscape to protect their patients. Today’s [May 18] decision is an important step forward that should give providers the legal clarity and backing they need to do what they do best: provide compassionate, medically necessary healthcare.

By clarifying the vital protections of the Colorado Anti-Discrimation Act, the Court has made clear that healthcare for transgender Coloradans is protected by state law. This ruling firmly reinforces that medical decisions should be made by patients, their families, and the medical providers they trust.

Colorado is once again showing the nation that we are a leader in protecting, advancing, and defending LGBTQIA+ rights. We are proud to stand alongside our families and our healthcare community as we continue to move forward, together. In solidarity.
